High Court strict on illegal arrest of Bhilai hotelier, orders to give Rs 1 lakh compensation to government

Chhattisgarh: Taking a tough stand on the serious negligence of the police and administration in the Bhilai illegal arrest case, the High Court has ordered the state government to pay a compensation of Rs 1 lakh to the victim. The court has clarified that this amount can be recovered from the guilty police officers after investigation. Describing this case as a serious violation of human rights and personal freedom, the High Court commented strongly on the police action.

The case is related to Akash Kumar Sahu, resident of Avantibai Chowk, Bhilai, who besides being a law student, runs a hotel in Kohka area. Akash Sahu had filed a petition in the High Court calling the police action illegal and unconstitutional. He said the hotel was fully registered and operating with a valid license.

According to the petition, on September 8, 2025, police officers reached the hotel and in the name of interrogating the people staying, started checking the register and identity documents. It is alleged that a room was forcibly entered without a female policeman and the hotel staff was misbehaved. Later, the police falsely accused the employees of theft and allegedly beat up the hotel manager brutally.

When hotel owner Akash Sahu reached the spot, the police misbehaved with him and when he protested, he was forcibly detained, arrested and sent to jail. The police claimed that they were searching for a missing girl and the action was taken for obstructing government work.

The High Court found that there was no cognizable offense registered against the petitioner and the arrest on the basis of mere suspicion was a violation of Article 21 of the Constitution. The court also expressed displeasure over the role of the SDM and quashed all the criminal proceedings. Besides, instructions have been given to make the police sensitive towards human rights.
